Copyright and DMCA

Our position

Swaay Media respects copyright. We have an archive spanning roughly a decade and thousands of contributors, and we accept that mistakes exist in it. We remove infringing material promptly when it is identified.

Filing a notice

Send a notice to [email protected] with the subject line "DMCA Notice". Under 17 U.S.C. § 512(c)(3) it must include all of the following, or we may not be able to act on it.

1. Your physical or electronic signature.

2. Identification of the copyrighted work you say has been infringed.

3. The URL of the material on our site, specific enough that we can find it.

4. Your name, postal address, telephone number and email address.

5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.

6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act for them.

We aim to acknowledge within two business days and to act within ten.

Counter-notice

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you hold that good-faith belief, your contact details, and your consent to the jurisdiction of the federal court for your district.

We may restore the material within ten to fourteen business days unless the original complainant files a court action.

Contributor takedown requests

If you wrote for Swaay in the past and want your work removed from the archive, you do not need a formal DMCA notice. Email us from the address associated with your byline and we will handle it.

We will honour the request, and we may keep the URL redirecting so that inbound links do not break.

Repeat infringers

We terminate the accounts of contributors who repeatedly infringe copyright.
